Mortgage Fraud Allegations Rock New York AG Letitia James

New York Attorney General Letitia James is under federal scrutiny following a formal criminal referral issued by the U.S. Federal Housing Finance Agency (FHFA), alleging she falsified key mortgage documents and misrepresented property information to obtain favorable loan terms. The case, detailed in a federal letter dated April 14, 2025, is supported by investigative work from forensic accountant Sam E. Antar and now sits before the U.S. Department of Justice for potential criminal prosecution.

According to the FHFA’s Director William J. Pulte, James may have committed violations of multiple federal laws, including wire fraud, bank fraud, and false statements to financial institutions under 18 U.S.C. §§ 1341, 1343, 1344, and 1014. The charges stem from two separate properties—one in Virginia and the other in Brooklyn—where James allegedly manipulated mortgage applications and occupancy declarations to gain access to government-backed loans and reduced interest rates.

A Trail of Paperwork

Antar’s investigation, built on public records, court filings, mortgage documents, and property permits, raises serious ethical and legal questions about James’s conduct. His findings show a consistent pattern of discrepancies and misstatements across nearly two decades.

In 2023, James purchased a home at in Norfolk, Virginia. In legal filings, including Fannie Mae/Freddie Mac Form 3047, she designated this property as her “primary residence”—a classification that qualifies borrowers for lower interest rates. However, as a statewide elected official in New York, James is legally required to maintain her primary residence in New York. Complicating matters further, a New York City building permit dated July 15, 2024, lists her Brooklyn home as “James Residence,” confirming it remained occupied during that time.

The FHFA notes that mortgages for secondary residences typically come with higher interest rates—often 0.25% to 0.50% more—due to increased lending risks. Misrepresenting a second home as a primary residence to receive more favorable terms is considered mortgage fraud.

Brooklyn Misrepresentation

The scrutiny doesn’t end in Virginia. At the center of the second set of allegations is James’s long-held property at 296 Lafayette Avenue in Brooklyn, NY. Records show the building has had a five-unit occupancy classification since at least 2001. Yet, James has repeatedly described the property as a four-unit building on mortgage applications, building permits, and filings for government assistance, including a 2011 application under the Home Affordable Modification Program (HAMP).

That misclassification may have enabled her to obtain conforming loans through Fannie Mae and Freddie Mac, which are only available for properties with four or fewer residential units. These loans typically offer better interest rates and terms designed to assist lower- and middle-income homeowners.

The FHFA also documented a 2019 refinance of the Brooklyn property where the same four-unit claim was used. According to the agency, the continued misrepresentation likely allowed James to bypass stricter lending criteria that would have applied to a five-family dwelling—including higher interest rates, larger down payments, and commercial loan requirements.

A Pattern of Falsification

Further undermining James’s credibility are historic filings dating back to the 1980s. In both 1983 and 2000, James signed mortgage applications listing her and her father as “husband and wife”—a legal misstatement the FHFA says was used to meet mortgage approval requirements.

Though older, these examples suggest a long-standing pattern of falsifying information for financial benefit. The FHFA compared this case to recent high-profile mortgage fraud prosecutions, such as the conviction of former Baltimore State’s Attorney Marilyn Mosby for similar misrepresentations. So that means there is already established case law if James is actually charged.

Political Fallout

The criminal referral lands at a politically charged moment. James has played a high-profile role in targeting Donald Trump and other political figures. Ironically, she now faces a legal scenario similar to those she has publicly championed. The FHFA’s referral to Attorney General Pam Bondi and Deputy AG Todd Blanche has triggered bipartisan calls for accountability, especially given James’s top law enforcement role in New York State.

As of now, Letitia James has not publicly responded to the criminal referral or the findings laid out in the FHFA’s letter. However, the charges, if pursued, could mark a turning point not only in her political career but in public trust in the office she holds.

The investigation underscores a broader issue: that no one—not even a state’s chief legal officer—is above the law. With court filings, property records, and mortgage documents painting a detailed picture of alleged fraud, the coming months could determine whether James’s legal fate mirrors that of other public officials who misused the public trust for personal financial gain.

  1. Your article would have been more informative had it noted a prosecution of Marilyn Mosby for essentially what James is alleged to have done. You also could have noted that the New York bar may open an investigation.

    • Yes I did mention the Mosby case. I said, Baltimore State’s Attorney Marilyn Mosby for similar misrepresentations. So that means there is already established case law if James is actually charged. As for the NYS Bar, I believe it premature because there are no official charges. Thank you for your comment

The recent buyout of Tyler Perry’s ownership stake in BET+ marks more than a corporate restructuring. It signals the end of the last remaining piece of Black ownership connected to the BET ecosystem. With Paramount Global purchasing Perry’s stake, the streaming service is now fully controlled by the same corporation that already owns Black Entertainment Television. BET+ is expected to be folded into Paramount+ as part of the company’s broader strategy to consolidate its streaming platforms. For many viewers, this may look like a routine business decision. Large media companies restructure assets all the time. But the symbolism of this particular transaction is difficult to ignore. Tyler Perry’s investment in BET+ represented the final direct ownership link between Black capital and the BET brand. While BET itself had long been part of a corporate media structure, Perry’s stake in the streaming platform meant that a major Black creator still held equity in a piece of the distribution system tied to the network. That is no longer the case. With the buyout complete, the entire BET ecosystem now sits fully inside Paramount Global’s corporate portfolio. What once stood as a Black-owned media institution has become another brand within a multinational entertainment conglomerate. This distinction matters because ownership and representation are not the same thing. Black culture remains one of the most powerful forces in global entertainment. Black actors, writers, directors, musicians, and producers continue to shape popular culture at every level. But influence does not equal ownership. Ownership determines who controls the platform. Ownership determines who captures the long-term economic value created by media. Ownership determines who ultimately decides what content is produced and how it reaches audiences. This does not mean Black creators will disappear from television or streaming platforms. Black culture will continue to drive audiences, shape trends, and influence global entertainment. The real question is not whether Black content will exist. The real question is what kind of Black content will be produced — and who will decide what stories are told. Who will control how our history is portrayed?Who will shape the narratives about our communities?And what will our children be taught about our culture through the media they consume? Major studios and networks understand the economic value of Black cultural influence. But when ownership of the platforms sits entirely outside the community, the power to define the message no longer belongs to the culture that created it. For decades, BET symbolized something larger than entertainment. It represented the possibility that Black entrepreneurs could build and control a national media platform. Even after the network itself became part of a corporate structure, Tyler Perry’s stake in BET+ maintained at least some connection between Black ownership and the distribution of Black-focused content. That connection is now gone. Security Questions Emerge After Police Kill Man Linked to Rep. Jasmine Crockett

A deadly police shooting in Dallas has raised new questions after authorities confirmed the man killed had previously worked security at events connected to U.S. Representative Jasmine Crockett. The man, identified in reports as Mike King, was shot and killed by Dallas Police Department officers following a tense standoff earlier this week. While police say the shooting occurred after the suspect pointed a gun at officers, the revelation that he had previously worked security connected to a member of Congress has triggered scrutiny over vetting and security practices. What Happened According to police, officers were attempting to arrest King on a warrant related to impersonating a law enforcement officer. Authorities tracked him to a parking garage near Children’s Health Hospital in Dallas, where he barricaded himself inside a vehicle. A SWAT response team was called to the scene. After negotiations failed, officers deployed tear gas to force him out of the vehicle. Police say that when King exited the car, he emerged holding a firearm and pointed it toward officers. Officers opened fire.King was pronounced dead at the scene. No officers were injured during the incident. A Security Contractor With Political Connections Investigators later confirmed that King had previously provided security services at events involving Rep. Jasmine Crockett, a first-term Democratic congresswoman representing parts of Dallas and surrounding areas. Reports indicate King operated a company that connected off-duty police officers with private security jobs, including political events. Campaign finance records and public documentation reportedly show payments for security services linked to Crockett’s events within the past year. There is currently no indication that Crockett or her office were aware of any criminal investigation involving King prior to the incident. Her office has not issued a formal statement about the situation as of this writing. Allegations of Police Impersonation The warrant that led police to King was connected to allegations that he had been impersonating a law enforcement officer. Investigators say he was suspected of using: A replica undercover police-style vehicle Stolen or altered license plates Multiple aliases Authorities are still investigating the full scope of those allegations. Questions About Security Vetting The incident has raised broader questions about how private security contractors are vetted for political events, particularly for elected officials who frequently rely on private firms rather than government protective services. Members of Congress typically do not receive full-time federal protection unless they hold leadership roles or face specific threats. As a result, many campaigns and offices hire private security contractors for events. The Dallas shooting has now sparked debate over whether additional background checks or licensing requirementsshould be implemented for individuals providing security for elected officials. The Larger Debate For critics, the situation highlights what they see as a growing problem with the loosely regulated private security industry. Others argue the focus should remain on the circumstances of the police encounter itself, noting that officers say the shooting occurred only after the suspect pointed a weapon at law enforcement during an active standoff. The investigation into the incident is ongoing. What is clear is that the case now sits at the intersection of law enforcement, political security, and public accountability—a combination that almost guarantees continued scrutiny in the days ahead.
