City Council Says Acting Mayor Wallace’s Re-Appointment of Shawn Harris As Police Commish Is Not Supported By The Charter

The Mount Vernon City Council released a statement Tuesday morning that they do not believe the actions of Acting Mayor Andre Wallace re-appointing Shawn Harris as Commissioner of Public Safety was supported by the City Charter.

The City Council was unaware of yesterday’s decision to appoint a different Police Commissioner. The City Council does not believe that this decision is supported by the City Charter which allows an Acting Mayor to make changes after 60 days in office. 

Section 61 of the City Charter that the City Council President in the mayor’s absence can exercise any power of the Mayor except any powers of appointment or removal from office for 60 days (see the charter section below).

While some have interpreted the section does not apply because Richard Thomas definitely would not be returning to the office within 60 days due to his pleading guilty to two misdemeanors last week for misusing $12,900 in campaign funds in 2015, other feel it literally means 60 days with no exception. by the Council’s statement, they believe the latter.

Earlier in the day, Tuesday morning newly re-appointed Police Commissioner Shawn Harris was arrested at the Mount Vernon Police Department, when he arrived at the station to report to work, for a concealed weapon and trespassing charges.

Richard Thomas maintains he is still the mayor and continues to work in the mayor’s office with a pair of police officers posted outside until late each night.
