Don’s Rant: The Unlawful Arrest Of Latt George by Mt. Vernon Mayor Richard Thomas

I have interviewed several people that were present at the City Council meeting Wednesday night. In MY opinion, you were right Latt in defending your mother from Butch Thomas.

This tactic utilized by the Thomas administration is UNLAWFUL. Now, according to NYS Penal Law Section 240.20 – Disorderly Conduct, Section 2; He makes unreasonable noise or Section 3: In a public place, he uses abusive or obscene language, or makes an obscene gesture.

In regards to these sections, the offender has to be advised by an officer that his actions are UNLAWFUL. If the offender continues his actions, he is subject to arrest. In your case, you were NOT advised therefore it was an UNLAWFUL ARREST.

Now, there is documentation that the City Council has authority over city council meetings. Only temporary Council President, Andre Wallace could’ve authorized that arrest if Latt was in violation of the aforementioned sections of the NYS Penal Law.

Secondly, Disorderly Conduct is NOT a crime. It is a violation. Latt could’ve been issued a Desk Appearance Ticket and been on his merry way.

Mayor Richard Thomas is using the Mount Vernon Police Department as his personal GHESTOPO. Latt, get a lawyer, file the Notice of Claim and sue RICHARD THOMAS.
