Before, Dave & Buster’s could apply for a building permit, conditions had to be set and a new law was passed to allow amusement games in the Pelham Manor Business District, Dave and Busters is which is now above Fairway Market in the Post Road Shopping Center, accepted Pelham Manor’s conditions, and in return the Board of Trustees approved the local law necessary for the restaurant/arcade amusement center to operate in the village.
Only one resident, Lynn Dintrone, commented at a public hearing on the issue Feb. 24, according to The Pelhams-Plus.
Here are the operating conditions set by Pelham Manor:
1. Dave and Busters will spend up to $15,000 to install traffic signage
2. No table service of alcoholic beverages anywhere in the restaurant in which an amusement device is located
3. No one under 16 will be permitted to operate an amusement device after 10 p.m. unless accompanied by a parent or guardian over the age of 25.
4. Deliveries will be limited to 7 a.m. – 4 p.m. on weekdays; 9 a.m. – 4 p.m. on Saturdays and 10 a.m. – 1 p.m. on Sundays.
5. The restaurant will provide for and maintain an off-duty, uniformed Pelham Manor police officer on the premises from 11 p.m. until its midnight closing every day it’s open.
6. The restaurant will give the village $135,000 “to mitigate the impacts of the proposed amusement devices on the Pelham Manor Police Department.”
7. Dave & Buster’s will also pay an annual license fee of $150 per amusement device ($30,000 for 200 games).
8. The restaurant will install security cameras inside and outside, with the surveillance footage from the interior cameras to be retained for 90 days and provided to the Pelham Manor Police Department upon request.
9. Any authorized representative of the village can enter at any time it’s open to check for compliance with these conditions.
